Earnd is committed to keeping your personal, financial and technical information safe. We will safeguard yourdata and protect your privacy using industry-leading technology and practices. The following Privacy Policy details what data we collect and how we use it to operate and deliver our Services.

  1. What Data We Collect, Use, Integrate and Share

1.1       Types of Data We Collect. In connection with accessing our Services, we may collect information from you which can be used to identify you (“Personally Identifiable Information” or “PII”), such as your name, billing address, email address, phone, username, password, financial data and how/when you interact with our Services.

We collect information when you open or register an account, sign in, engage in an Incentive Study Order, seek support, pay an Incentive Study Order invoice, or give us feedback. We may also get information from other companies or third parties, such as when you sync a third-party account or service with our Services, or when we may use third-party service providers to supplement the PII you give us (e.g., validate your mailing address) to help us maintain the accuracy of your data and provide you with better service. We also collect content or other information that you may provide or create when you interact with our Services.

We may also automatically collect certain usage information when you access our Services (“Usage Data”), including but not limited to, Internet Protocol (“IP”) addresses, MAC address, IMEI, other unique device identifiers, log files, pages viewed, browser version and type, any links you click on to leave or interact with our Services, and other usage information collected from Cookies and other tracking technologies.

We do not collect any special categories of PII such as details about your race or ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, union membership, or health.

1.2       How We Use Your Data. We may Process your information, including your PII, for the following purposes:

Account Registration. We may use your PII to register your account for our Services we provide and to communicate important information to you. We may obtain additional PII about you, such as address change information, from commercially available sources, to keep our records current. If you set up an account that is accessed by people other than you, please note they may see, change or delete your PII.

Provide Our Service. We may use your information to operate our business, including providing you our Services, providing you with support related to our Services, and protecting you and other users of our Services.

Provide Customer Service or Technical Support. We may use your PII and information about your computer configuration to resolve questions you have about our Services and to follow up regarding your experience.

Communicate with You. We may use your information to market additional Services from us or third parties we believe may be of use to you. Please see below under “How You Can Manage Your Privacy” for the choices you have regarding these communications.

Improve our Services or Develop New Services. We may use your information to customize your experience, develop new functionality or services, and improve our network or information security.

Solicit Feedback. We may use your information to obtain feedback or conduct voluntary surveys.

Generate Anonymized Analytics. We may Process PII and other information about you to create anonymized and aggregated information, such as anonymized demographic information, location information, or other analyses we create. Anonymized or aggregated information is not PII and may be used for research, internal analysis, analytics, and any other legally permissible purposes unconditionally and without notice.

1.3       How We Integrate Your Data. We may need to sync, link, or connect third-party applications and services. To sync with the online account of your financial, time tracking, and other technology applications, we may request your username, security credentials, and other login data to enable our access. In the event we are given your login credentials and/or login data, the data will be encrypted both in transit and at rest using industry-standard encryption technology. We may use this information to update and maintain your data, to assist with the download process, and to enhance our Services we provide. You hereby consent to give such third-party applications the right, power, and authority to act on your behalf to provide us access and transmit to us information from your synced accounts. You acknowledge and agree that such information will be treated by each application in accordance with its respective privacy policy. To the extent our Services or site provides external links, you further acknowledge your understanding that the external sites are not operated by us and we strongly advise you to review their respective privacy policy. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

1.4       How We Share Your Data. We may need to share your PII with others.

Third-Party Service Providers. We may share your information, including PII and Usage Data, with third-party service providers who perform various functions to enable us to provide our Services and help us operate our business, such as website design, sending email communications, fraud detection and prevention, customer care, or performing analytics. Our contracts with third parties will require them to maintain the confidentiality of the PII they receive from us, only act on our behalf and under our instructions, and not use any of the PII for purposes other than for the product or service they provide to us or on our behalf.

Protect Earnd, our User Community and Others. We may share account information, PII and Usage Data when we believe it is appropriate to enforce Earnd’s Engagement Agreement and other agreements; or protect the rights, property, or safety of Earnd, our Services, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. This does not include selling, renting, sharing, or otherwise disclosing PII of our customers for commercial purposes in violation of the commitments set forth in this Privacy Policy.

Response to Subpoenas and Other Legal Requests. We may share your information with courts, law enforcement agencies, regulators or other government bodies when we have a good faith belief we are required or permitted to do so by law, including to meet national security or law enforcement requirements, to protect our company, or to respond to a court order, subpoena, search warrant, or other law enforcement request.

Reporting to Credit Providers. We may share your information with credit bureaus, consumer reporting agencies, card associations, government agencies and their respective agents regarding late or missed payments, defaults on your account or indications of fraud.

Merger, Sale or Other Asset Transfer. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of our Services to another provider, we may be required to share, sell or transfer your information following any change of control.

With your Consent. Other than as set out above, we will provide you with notice and the opportunity to choose when your PII may be shared with other third parties.

  1. How You Can Manage Your Privacy

2.1       Updating Your PII. In connection with your right to manage your PII you provide to us, you may access, update, change, correct or request deletion of your information either through our Services or through our customer support. You can reach our customer support by using the contact information provided in the “Contact Us” section of this statement.

2.2       Managing Marketing Communication. We will honor your choices when it comes to receiving marketing communication from us. If you choose not to receive marketing communication from us, we will only send you non-promotional mandatory Service-oriented or transactional communications.

2.3       Cookies and Other Tracking Technologies. In accordance with applicable law, Earnd and our third-party service providers may use commonly used tools to recognize your visit and track your interactions with our Services such as cookies, web beacons, pixels, local shared objects, and similar technologies (collectively, “Cookies”). Cookies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that allow tracking and recording certain pieces of engagement information whenever you visit or interact with our site and Services. This tracking is frequently necessary for us to provide you our Services. Other times, we may combine Usage Data collected from Cookies with that of other customers to improve your and other customers’ experience. You have some control over the Usage Data we collect from Cookies and how we use it in your browser settings. If you opt out, later delete your Cookies, use a different browser, or buy a new computer, you may need to renew your opt-out choices.

2.4       Do Not Track. Like most other companies, our site and Services are not currently configured to respond to browsers’ “Do Not Track” signals because no formal “Do Not Track” standard has been adopted at this time.

2.5       Social Media Features. Our Services may use social media features, such as LinkedIn and Facebook sharing. These sites often collect your IP address and which page you are visiting within our Services using Cookies. Your interactions with these features are governed by the privacy policy of the respective Social Media company.

  1. Data Retention and Your Access, Rectification and Erasure Rights

3.1       Data Retention. In accordance with and as permitted by applicable law and regulations, we will retain your information as long as necessary to serve you, to maintain your account if it is active, or as otherwise needed to operate our business. If you close your account, we may continue to communicate with you about our Services as detailed above, give you important business updates that may affect you, and let you know about products and services that may interest you, unless you have opted out of receiving marketing communications. We will further retain and use your information as allowed or required by applicable regulations to comply with our legal and reporting obligations, resolve disputes, enforce our agreements, complete outstanding transactions, and detect and/or prevent fraud.

3.2       Your Access, Rectification and Erasure Rights. In accordance with applicable law, you may have the right to: (i) request confirmation of whether we are Processing your PII; (ii) obtain access to or a copy of your PII; (iii) receive an electronic copy of PII that you have provided to us, or ask us to send that information to another company (the “right of data portability”); (iv) restrict our uses of your PII; (v) seek correction or amendment of inaccurate, untrue, incomplete, or improperly processed PII; and (vi) request erasure of PII held about you by Earnd, subject to certain exceptions prescribed by law.   1. Security of Your Data

We implement various security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition to training our staff and requiring they safeguard your data., we will limit access to your PII to those employees, agents, contractors and other third parties who have a business need to know. They may only process your PII on our instructions and will be subject to a duty of confidentiality.

The Internet cannot be guaranteed to be 100% secure, so we cannot ensure or warrant the security of information you provide to us. We will constantly work to update our security practices and to implement recognized best methods to protect your PII. And, we will comply with applicable laws and security standards. We will not, however, accept liability for unintentional disclosure to the fullest extent permitted by applicable law.

  1. Children’s PII.

Our Services are intended for and directed to adults. Our Services are not directed to minors, and we do not knowingly collect PII from minors.

  1. California Privacy Rights

We shall not sell PII as the term “sell” is defined by the California Consumer Privacy Act (CCPA) nor shall we disclose or transfer PII to a third party or other parties that would constitute “selling” as the term is defined by the CCPA.

  1. International Data Transfers

In accordance with and as permitted by applicable law and regulations, we reserve the right to transfer your information, Process and store it outside your country of residence to wherever we or our third-party service providers operate. Notably, General Data Protection Regulation (GDPR) data privacy laws do not permit transfers of resident company or individual data.

  1. Privacy Policy Changes

We reserve the right to make Privacy Policy changes or updates at any time. If we make material changes to the way we Process your PII, we will provide you notice via our Services or by other communication channels, such as by email or community post. Please review any changes carefully. If you object to any of the changes and no longer wish to use our Services, you may close your account(s). All changes are effective immediately upon posting and your use of our Services after a notice of material change or posting of an updated Privacy Policy shall constitute your consent to all changes.

Definitions

“Personally Identifiable Information” or “PII” is any information relating to an identified or identifiable natural person.

“Process” or Processing means any operation which is performed upon PII, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.
